Grand jury returns 44 indictments

Two inmates who escaped from the Western Kentucky Correctional Complex in August 2008 have been indicted for their crimes by a Caldwell County grand jury.

Forty-four felony indictments, two misdemeanor indictments and four no true bills were returned by the grand jury, which was in session Sept. 14, 15 and Oct. 6.

The indictments were released by the Caldwell County Circuit Clerk’s Office Tuesday.

Jesse J. Sebastian, 44, and James Whisman, 27, were indicted on charges of complicity to third-degree burglary, receiving stolen property (firearm), theft by unlawful taking over $300, possession of a firearm by a convicted felon and being persistent felony offenders in the first degree.

The charges were all incurred during the duo’s time on the lam, from Aug. 16 to Sept. 5, according to court records.

Clothing, tools and a rifle believed to have been taken by the inmates were recovered in Princeton in December.

Circuit Judge C.A. Woodall III set bonds of $12,500 cash for each inmate in connection with the crimes. Both remain incarcerated at WKCC in Fredonia.

In other cases presented to the grand jury:

• Julie C. Flynn, 20, of 404 Cadiz St., Apt. 5, was indicted for trafficking in a controlled substance, first degree, first offense (cocaine), trafficking in marijuana less than 8 ounces, first offense, and possession of drug paraphernalia, first offense.

The charges stem from a May 29 incident. A warrant was issued, with bond set at $10,000. Flynn was released on a surety bond on Oct. 12.

• Mark D. Wilson, 21, of 405 North Harrison St., was indicted for trafficking in marijuana more than 8 ounces, less than 5 pounds, unlawful transaction with a minor, second degree (two counts), and fleeing or evading police, second degree.

The charges stem from an Oct. 8 incident. A warrant was issued, with bond set at $7,500 cash.

• William T. Dunn, 43, of 402 South Seminary St., was indicted for trafficking in a controlled substance, first degree, first offense, and trafficking in a controlled substance, second degree, first offense.

The charges stem from incidents on Feb. 4 and March 30.

A district court bond of $10,000 surety was posted June 8. A summons was issued.

• Jimmy G. Oliver, 29, of 209 Locust St., Kuttawa, was indicted for trafficking in a controlled substance, second degree, first offense.

The charge stems from a Dec. 22, 2008, incident. A district court bond of $2,500 cash was posted on Feb. 17. A summons was issued.

• Dwight W. Pierce (also known as Dwight Odom), 37, of 304 Bell St., had four indictments returned on charges of trafficking in a controlled substance, second degree, first offense.

The charges stem from incidents that occurred between Jan. 4 and Feb. 9.

A district court bond of $6,500 cash was posted Feb. 10. A summons was issued.

• Alexis “Lex” Samuel, 44, of 25 Corey Lane, had two indictments returned on charges of trafficking in a controlled substance, first degree, first offense.

The charges stem from incidents that occurred on Nov. 24 and 25.

A district court bond of $1,000 cash was posted on April 27. A warrant was issued, with bond set at $10,000 cash.

• David Allen Bates Jr., 22, of 323 South Harrison St., had two indictments returned on charges of trafficking in a controlled substance, second degree, first offense.

The charges stem from incidents that occurred Feb. 1 and 2.

A $10,000 property bond was posted April 13. A summons was issued.

• Jessica L. Hollis, 22, of 846 Maple St., had two indictments returned on charges of trafficking in a controlled substance, second degree, first offense.

The charges stem from incidents that occurred on Nov. 2 and 3.

A $5,000 surety bond was posted April 6. A summons was issued.

• Minetta R. Vickery, 25, of 3591 Cannon Road, had two indictments returned on charges of trafficking in a controlled substance, second degree, first offense.

The charges stem from incidents that occurred Nov. 23 and Dec. 9.

A $10,000 property bond was posted April 14. A summons was issued.

• Ashley R. Pratt (also listed as Pruitt), 28, of 105 Marshall Road, Eddyville, was indicted for trafficking in a controlled substance, first degree, first offense (meth).

The charge stems from a Dec. 16 incident. A warrant was issued, with bond set at $10,000 cash.

•Anthony D. Wilson, 22, of 406 West Green St., had three indictments returned on charges of trafficking in a controlled substance, first degree, first offense (cocaine).

The charges stem from incidents that occurred on Dec. 10, Dec. 18 and Jan. 19.

Wilson remained jailed on a $15,000 cash bond. A warrant was issued, with a $10,000 cash bond imposed.

•Samuel A. Rolley, 19, of 6301 Ky. 126, was indicted for two counts of second-degree burglary.

The charges stem from a July 13 incident.

Rolley remained jailed on a bond of $5,000 cash or $10,000 property. A warrant was issued, with bond set at $7,500 cash or $15,000 property.

• Wendell Perry Taylor, 50, of 516 North Cave St., had two indictments returned on charges of trafficking in a controlled substance, first degree, first offense (cocaine).

The charges stem from incidents that occurred March 11 and 12.

Taylor remained jailed on a $15,000 cash bond. A warrant was issued, with bond set at $10,000 cash.

• Jason Paul McKinney, 36, of 117 Willow St., Fredonia, was indicted on charges of second degree burglary and theft by unlawful taking over $300.

The charges stem from incidents that occurred June 12 and 13, 2008.

McKinney remained jailed on a $5,000 cash bond. A warrant was issued, with bond set at $7,500 cash.

• Ashley N. Varble, 23, of 423 Wynn Road, was indicted on charges of theft by unlawful taking over $300, driving on a DUI-suspended license, first offense, and DUI, second offense.

The charges stem from a June 19 incident.

A district court bond of $5,000 surety was posted June 30. A summons was issued.

• Samuel D. Ritter, 35, of 3826 Ky. 93 South, Eddyville, had three indictments returned.

The first was for four counts of criminal possession of a forged instrument, second degree, stemming from April 3-4 incidents.

The second was for fraudulent use of a credit card over $100 within a six-month period, stemming from incidents that occurred between March 2 and March 9.

The third was for 10 counts of criminal possession of a forged instrument, second degree, stemming from incidents that occurred from March 25 to April 3.

Ritter remains jailed in Crittenden County as a state inmate. Warrants were issued, with bond set at $2,500 cash.

• Christi B. Matthews, 31, of 7155 Ky. 819, Kuttawa, had two indictments returned.

The first was for criminal possession of a forged instrument, second degree (seven counts), stemming from incidents that occurred between March 24 and April 22.

The second was for one count of theft by failure to make required disposition of property over $300 and one count of theft by failure to make required disposition of property under $300, stemming from March 9 and May 5 incidents.

A district court bond of $5,000 surety was posted May 18. A summons was issued.

• Justin K. York, 21, of 5064 Ky. 120, Marion, was indicted for first-degree criminal abuse.

The charge stems from a May 26 incident.

A $5,000 surety bond was posted June 2. A summons was issued.

• Brandon James Brasher, 24, of 174 Tish Road, had two indictments returned.

The first, for criminal possession of a forged instrument, second degree, stems from incidents that occurred between June 22 and July 1.

The second, for being a convicted felon in possession of a firearm, stems from a July 22 incident.

A $2,500 surety bond was posted on Aug. 10. A summons was issued.

• Ryan E. Knight, 20, of 229 Saratoga Heights, Eddyville, was indicted on a charge of first-degree criminal mischief.

The charge stems from a Feb. 19 incident.

Knight remains jailed in Crittenden County on a $2,500 cash bond. A warrant was issued, with bond set at $2,500 cash.

• Catherine R. Blout, 34, of 407 North Harrison St., was indicted for third-degree assault (two counts), resisting arrest and hindering prosecution or apprehension in the second degree.

The charges stem from a July 5 incident.

An $8,500 property/surety bond was posted July 6. A summons was issued.

• Jamar M. McGowan, 20, of 520 North Plum St., was indicted for complicity to second-degree burglary.

The charge stems from a June 5 incident.

A $5,000 surety bond was posted June 5. A summons was issued.

• Avery M. Matthews, 19, of 314 North Donnivan St., had two indictments returned.

The first, on a charge of complicity to second-degree burglary, stems form a June 5 incident.

A $5,000 surety bond was posted June 5. A summons was issued.

The second, for first-degree robbery, stems from a July 11 incident.

Matthews remained jailed on a $5,000 cash bond. A warrant was issued, with bond set at $7,500 cash.

• Johnathan R. Walton, 25, of 1014 East 7th St., Hopkinsville, was indicted for possession of a controlled substance, first degree, first offense, and possession of drug paraphernalia, first offense.

The charges stem from a May 6, 2008, incident.

A $2,500 surety was posted on May. 8, 2008. A summons was issued.

• Michael L. Lipson, 19, of 109 West Green St., was indicted for third-degree assault, fourth-degree assault, resisting arrest and inciting a a riot.

The charges stem from a July 5 incident.

A $6,500 property or surety bond was posted July 6. A summons was issued.

• Leaston M. Beasley, 19, of 123 Highland Ave., was indicted for two counts of criminal possession of a forged instrument, second degree.

The charges stem from Feb. 28 and March 1 incidents.

A $2,000 surety bond was posted May 18. A summons was issued.

• Brandi N. Walls, 24, of 18467 Marion Road, Fredonia, was indicted for obtaining a controlled substance by false statement and second-degree forgery.

The charges stem from a July 14 incident.

A $5,000 surety bond was posted July 18. A summons was issued.

• Alicia N. Shearer, 21, of 404 Cadiz St., Apt. 5, had a misdemeanor indictment returned on charges of trafficking in marijuana less than 8 ounces, first offense, and possession of drug paraphernalia, first offense.

The charges stem from a May 29 incident.

A no true bill was returned on a charge of selling or transferring a simulated controlled substance, second offense.

A $10,000 surety bond was posted June 1.

• Cassie Trusty, 20, of 6301 Ky. 126, had a misdemeanor indictment returned on charges of possession of a controlled substance, third degree, and possession of marijuana.

The charges stem from incidents that occurred Oct. 4, 2007.

A $750 surety bond was posted Oct. 5, 2007.

• Brett Sherrill, 36, of 400 Cooper Circle, had a no true bill returned on charges of possession of a controlled substance, second degree, second offense, and having a prescription controlled substance not in its original container.

• Matthew E. Hawkins, 33, of 1671 Eddy Creek Church Road, had a no true bill returned on a charge of possession of a controlled substance, first degree, first offense.

• Jennifer N. Davis, 25, of 3615 Magruder Road, Kevil, had a no true bill returned on a charge of possession of a controlled substance, first degree, first offense.

• Eight individuals had cases continued until the next grand jury session.

They include: Serena M. Hearn, Candice D. Lady, Randi Hale, Brandon R. Conrad, Avery M. Matthews, Levi Glover, Donald Ray Adams and Juanita Gray.

• The grand jury also issued a recommendation to the Caldwell County Fiscal Court to replace ceiling tiles where leakage had been noticed in the circuit courtroom and jury room.
